Terms of service

1. Parties

This agreement is made between [not specified] (INN [not specified], OGRN [not specified], address: [not specified]), the operator, and the user of the Genka service. The service runs on the website https://genka.io and through a Telegram bot and a Telegram mini app.

2. Public offer and acceptance

• This agreement is a public offer under Article 435 and Article 437(2) of the Civil Code of the Russian Federation.
• Any of the following counts as acceptance under Article 438(3) of the Civil Code: signing up on the website, signing in with Telegram, paying for coins.
• If you do not agree with these terms, do not sign up and do not use the service.

3. Account and security

• You need an account to generate and to pay: with email and password or through the Telegram bot.
• You are responsible for keeping your password and your Telegram access safe. Actions taken from your account are treated as yours.
• Do not hand your account to other people and do not create accounts to receive bonus coins again.
• You can delete your account in your profile. What gets deleted is described in the personal data policy.

4. Coins and payment

• Coins are digital units inside the service. They pay for generations and other paid features. Buying coins is a prepayment for these services.
• Prices in coins and the price of coin packs are shown on the pricing page before payment.
• When a task starts, coins are reserved. If the task is not completed, the reserve returns to your balance automatically.
• Coins cannot be transferred to another user or exchanged for money. Money can be refunded in the cases described in the refund document.

5. Bonus coins

• The operator may credit bonus coins for free for actions in the service. The terms are shown in the service before the action.
• The user pays nothing for bonus credits. Bonus coins cannot be exchanged for money.
• The operator does not promise any particular amount of future bonus credits and may change their terms.

6. Rights to materials

• Rights to the photos and texts you upload stay with you.
• You grant the operator a free non-exclusive license to process what you upload to the extent needed to fulfil your request.
• If you publish a work in the gallery, you grant the operator a free non-exclusive license to show it in the gallery until the publication is removed.
• You may use generation results for your own purposes if this does not break the law, the rights of others or the content rules.

7. User warranties

• You upload only materials that you have the right to use.
• If another person appears in a photo, you have their consent to use their image (Article 152.1 of the Civil Code).
• You settle on your own any third-party claims related to materials you upload.

8. AI results

• Images, videos and assistant replies are produced by neural networks. They may be inaccurate, may not match your expectation and are not professional advice.
• Images created by the service may carry an invisible marking that allows their origin to be identified.
• Do not present results as real photos or videos where this could mislead people.

9. Public gallery

Publishing a work in the gallery is voluntary, and you can remove it at any time. The gallery feed is ordered by date or by reactions and is not tailored to a particular user. Publications are checked against the content rules.

10. Liability

• The service is provided as is. The operator works to keep it running but does not guarantee uninterrupted operation.
• The operator is not responsible for how the user uses generation results.
• Limitations of liability do not apply where the law does not allow them, including consumer rights.

11. Disputes

This agreement is governed by the law of the Russian Federation. First send a claim to [not specified]. If the dispute is not resolved, it goes to court under Russian law, subject to the consumer right to choose the court.

12. Changes to the agreement

A new version is published on this page with its number and date. A new version does not change the terms for coins paid for before its publication.
